Two Jinn, Inc. v. Idaho Dept of Insurance

By unanimous decision, the Idaho Supreme Court ruled in favor of Two Jinn, Inc. dba Aladdin Bail Bonds versus the Idaho Department of Insurance overturning the DOI interpretation of Idaho Code § 41-1042 that prevented bail companies from contracting with a client to indemnify the company for the cost of apprehending a defendant who jumps bail when executing the bail bond. The court established that a bail bond company can contract for a client to indemnify the company for the cost of apprehending a bail jumper as a part of the bond agreement.
